To the natural resource departments of all provinces, autonomous regions, and municipalities directly under the Central Government, and the Natural Resources Bureau of the Xinjiang Production and Construction Corps:
In accordance with the Notice of the General Office of the Ministry of Natural Resources on Carrying Out the 2023 "Double Random, One Public" Supervision and Inspection of Geological Exploration and Geological Disaster Prevention Activities (Natural Resources Office Letter [2023] No. 623), the natural resource departments of 31 provinces (autonomous regions and municipalities) and the Natural Resources Bureau of the Xinjiang Production and Construction Corps have completed the 2023 supervision and inspection of geological exploration and geological disaster prevention activities by means of random spot checks, special inspections, and "look-back" re-inspections. The relevant situation is hereby notified as follows:
1. Overall Situation
Local natural resource departments attached great importance to the work, organized it carefully, made unified arrangements, and strictly followed the requirements of the "Double Random, One Public" work, and completed this year's supervision and inspection work well. The random inspection ratios in Hebei, Shanghai, Guangdong, Hainan, Ningxia, and other places all exceeded 20%. Tianjin refined the inspection standards, issued the "2023 Key Points for the 'Double Random, One Public' Supervision and Inspection of Geological Exploration and Geological Disaster Prevention Activities in Tianjin" and the "Detailed Record Form for Supervision and Inspection," further standardizing the supervision and inspection process. Heilongjiang innovated its working approach by adding two items—special random inspection of government-funded geological exploration projects and credit rating evaluation of geological exploration units—thereby improving the quality and effectiveness of supervision and inspection.
In 2023, a total of 659 geological exploration units were randomly inspected nationwide, and no obvious problems were found in 414 units. Among the 245 units with problems, 209 have completed rectification, 5 had their qualification certificates revoked and were placed on the list of entities with serious dishonesty, 1 was transferred to law enforcement authorities for handling, 4 were placed on the abnormal list, 5 had their qualification certificates canceled, 3 had their enterprise information deregistered from the supervision service platform, and 18 are still undergoing rectification.
2. Problems Found
(1) Some units committed fraud in the application for geological disaster prevention qualifications.
During supervision and inspection, the Department of Natural Resources of Fujian Province found that some units provided false materials when applying for qualifications. After the facts were clearly investigated, the geological disaster prevention qualifications obtained through improper means by five companies—Fujian Jiakang Construction Engineering Co., Ltd., Fujian Dingshengwang Construction Engineering Co., Ltd., Fujian Red Coral Construction Co., Ltd., Fujian Caiding Construction Co., Ltd., and Fujian Fanyi Landscape Construction Co., Ltd.—were revoked, and applications by the above units for geological disaster prevention unit qualifications will not be accepted for three years; they were also placed on the list of entities with serious dishonesty on the national geological exploration industry supervision service platform.
The Department of Natural Resources of Hubei Province combined supervision and inspection with the pre-review of geological disaster prevention qualifications and found that in two units—Songzi Jiangnan Water Conservancy and Hydropower Engineering Co., Ltd. of Hubei Province and Zhongtong Construction Co., Ltd.—some professional and technical personnel listed in the qualification application materials were in-service personnel of other units in other provinces, which did not meet the relevant approval requirements, and the applications were returned.
(2) A few geological disaster prevention units altered qualifications and illegally undertook geological disaster prevention business.
During inspection, the Department of Natural Resources of the Tibet Autonomous Region found that Tibet Tongyuan Engineering Survey and Design Co., Ltd. altered its geological hazard risk assessment qualification level from Grade C to Grade B and illegally undertook geological hazard risk assessment business, violating the Administrative Licensing Law, the Regulations on the Prevention and Control of Geological Disasters, and other laws and regulations. The case has been transferred to the Lhasa Municipal Natural Resources Bureau for serious investigation and handling in accordance with laws and regulations. The case is currently being processed.
(3) The professional personnel and equipment conditions of some geological disaster prevention units have changed.
Inspection found that 13 units—Ordos Xinhe Engineering Co., Ltd., Liaoning Tailida Ecological Environment Restoration Co., Ltd., Jilin Provincial Geological and Mineral Construction Group Co., Ltd., Zhejiang Dongzhuo Construction Co., Ltd., the Second Geological Brigade of the Guangdong Provincial Geological Bureau (Guangdong Shantou Geological Disaster Emergency Rescue Technology Center), Zhongtou Decheng Construction Engineering Co., Ltd., Guangzhou Wanbo Construction Engineering Co., Ltd., Shenzhen Environmental Geotechnical Engineering Co., Ltd., Chongqing Asia-Pacific Engineering Construction Supervision Co., Ltd., Chongqing Zhongtai Engineering Supervision Co., Ltd., Shaanxi Zhengkang Construction Engineering Co., Ltd., Gansu Fangyuan Engineering Supervision Co., Ltd., and Gansu Huaxia Geological Engineering Supervision Co., Ltd.—have had changes in the number of professional personnel or equipment as geological disaster prevention qualification units and can no longer meet the qualification requirements. The relevant provincial natural resource departments are urging the above units to apply for cancellation of qualifications or requiring rectification.
(4) Weak links remain in work safety management.
Inspection found that: the Superhard Materials Research Institute of the East China Metallurgical Geological Exploration Bureau has an insufficiently sound work safety management system and inadequate work safety training; Sinopec Petroleum Engineering Design Co., Ltd. has incomplete emergency plan content and some emergency drill content is inadequate; Hubei Yekan Geological Engineering Co., Ltd. lacks work safety education and training and has an imperfect emergency plan; Beijing Taili New Energy Technology Development Co., Ltd. has an imperfect field vehicle management system; Henan Baoyuan Exploration Technology Co., Ltd. lacks safety training records and hazard investigation ledgers; Guangxi Xinhang Land Planning and Design Co., Ltd. has not carried out investigation of work safety hazards; and Shandong Province Ludong Geological Engineering Co., Ltd. has not promptly updated and rectified its hazard ledger, and some fire extinguishers at project field construction sites are expired and have not been replaced in a timely manner.
(5) Information reporting and disclosure on the supervision service platform is not timely or accurate.
Some geological exploration units do not attach sufficient importance to information reporting and disclosure on the national geological exploration industry supervision service platform, and their information reporting is not careful or timely. Among the 245 units with problems, 105 had such problems, accounting for about 43%. For example, 17 units in Jiangxi were found to have problems such as incomplete reporting of project performance and bid-winning information and failure to promptly update and disclose relevant information, and 12 units in Guizhou were found to have problems such as untimely and incomplete information reporting.
3. Requirements for the Next Step
(1) Earnestly carry out classified handling and rectification of existing problems. In response to the problems found in this supervision and inspection, local natural resource departments must, in strict accordance with the Administrative Licensing Law of the People's Republic of China, the Regulations on the Prevention and Control of Geological Disasters, the Measures for the Administration of Qualifications of Geological Disaster Prevention Units, the Measures for the Supervision and Administration of Geological Exploration Activities (Trial), and other relevant requirements, investigate the facts clearly where geological disaster prevention units undertake geological disaster prevention business without qualification certificates or beyond the scope permitted by their qualification level, forge qualification certificates of geological disaster prevention units, or obtain qualifications through improper means, and adhere to "zero tolerance," resolutely investigating and handling such acts strictly and quickly in accordance with laws and regulations; where geological exploration units (including geological disaster prevention units) have problems in work safety management, they must be ordered to rectify within a time limit, follow-up supervision and urging must be strengthened, and timely re-inspection and re-verification must be conducted to ensure that all rectification is in place; where acts of dishonesty exist, they must be promptly included in the abnormal list and the list of entities with serious dishonesty.
(2) Vigorously improve the effectiveness of supervision and inspection. All localities should, in light of work practice, make efforts to strengthen the standardization of supervision and inspection and continuously improve the supervision and inspection work mechanism. Daily supervision and management must be strengthened so that illegal and non-compliant acts are discovered early, stopped early, and strictly investigated and handled; there must be the courage to tackle tough issues head-on, strict supervision and inspection must be carried out, and formalism and going through the motions must be avoided, so as to effectively discover and correct shortcomings and problems in the industry, punish dishonest acts, investigate and handle illegal acts, and maintain the order of the geological exploration industry; efforts to carry out publicity and information disclosure must be intensified, and information such as supervision and inspection results must be promptly disclosed and made public to society, and exposure of dishonest entities and acts must be increased to create a deterrent throughout the industry.
(3) Make effective use of the supervision service platform. All localities should conduct training on the use of the supervision service platform and improve the efficiency of platform use. Geological exploration units should be urged to independently complete the reporting of geological exploration and geological disaster activity information and to check, improve, and promptly update existing information. In work such as bidding for relevant government-funded projects in geological exploration, geological disaster prevention, and ecological restoration, government procurement, project commissioning, and the selection and recommendation of honors and awards, the credit information of geological exploration units should be fully used to improve the application level of the supervision service platform.
