On November 14, the official website of the Zhengzhou Emergency Management Bureau in Henan Province published the "Evaluation Report on the Implementation of Preventive and Rectification Measures for the '4·18' Relatively Major Collapse Accident at the Wuzhou Hot Spring Swimming Pool in Jinshui District" (hereinafter referred to as the "Rectification Evaluation Report").

At approximately 10:47 on April 18, 2022, a collapse accident occurred at the Wuzhou Hot Spring Swimming Pool of Zhengzhou Wuzhou Hotel Club Co., Ltd., located 100 meters south of the southeast corner of the intersection of Dongfeng Road and Tianming Road in Jinshui District, Zhengzhou, on the east side of the road, causing 3 deaths and 9 injuries, with direct economic losses of 4.3458 million yuan. Upon investigation, the accident was determined to be a relatively major production safety responsibility accident.

The accident investigation report previously published by Zhengzhou shows that the direct cause of the accident was: the roof structure of the swimming pool had been used in a humid environment for a long time, and the steel roof truss members, nodes and support parts were severely corroded, with a relatively large cross-section loss rate in some members, resulting in seriously insufficient strength and stability of the members, and the stability stress caused by loads on some members seriously exceeding the material strength. Under the action of upper loads, some members of the steel roof truss above the deep-water area of the swimming pool became unstable, leading to the collapse of the roof structure.

The Rectification Evaluation Report shows that, overall, the Jinshui District People's Government and its relevant units, departments and enterprises actively implemented the requirements of the Zhengzhou Municipal People's Government's "Reply on the Investigation Report of the '4·18' Relatively Major Collapse Accident at the Wuzhou Hot Spring Swimming Pool in Jinshui District" (Zheng Zheng Han [2022] No. 74), carefully compared the accident handling opinions and accident prevention measure recommendations, thoroughly identified the prominent problems exposed by the accident, refined work measures, and the accident accountability opinions and prevention and rectification measure recommendations have basically been implemented in place.

Implementation of the accident handling opinions:

Ma Taiyuan, former Party branch secretary of Shierlituu in Jinshui District and legal representative of Zhengzhou Tongle Enterprise Group Co., Ltd., was transferred to judicial authorities. On October 18, 2023, the Jinshui District People's Procuratorate made a relatively non-prosecution decision against Ma Taiyuan on the charge of major responsibility accident.

Wang Xibin, legal representative of Zhengzhou Wuzhou Hotel Club Co., Ltd., was transferred to judicial authorities. On October 18, 2023, the Jinshui District People's Procuratorate instituted public prosecution against Wang Xibin on the charge of major responsibility accident. The case has now been delivered to the Jinshui District People's Court and has not yet been heard.

According to the handling recommendations of the accident investigation report, the Jinshui District Emergency Management Bureau imposed administrative penalties on four persons: Wang Xibin (legal representative of Zhengzhou Wuzhou Hotel Club Co., Ltd.), Lü Moulong (manager of the Wuzhou Hot Spring Swimming Pool of Zhengzhou Wuzhou Hotel Club Co., Ltd.), Kang Moufei (deputy manager of the Wuzhou Hot Spring Swimming Pool of Zhengzhou Wuzhou Hotel Club Co., Ltd.), and Lian Mouxin (head of the engineering department of Zhengzhou Wuzhou Hotel Club Co., Ltd.). The fines have been paid and all have been implemented in place.

The accident investigation report recommended imposing an administrative penalty of 1.3 million yuan on Zhengzhou Wuzhou Hotel Club Co., Ltd. On December 5, 2022, the Jinshui District Emergency Management Bureau made an administrative penalty decision imposing a fine of 1.29 million yuan on Zhengzhou Wuzhou Hotel Club Co., Ltd., and the fine has been paid. Jinshui District has handled the relevant public officials in accordance with its handling authority, and the relevant departments have made inspections as required, all of which have been fully implemented.

In addition, because Zhengzhou Wuzhou Hotel Club Co., Ltd. had not obtained the "High-Risk Sports Business License" and had not completed housing lease registration and filing and other procedures, the roof of the illegally constructed building of the company's swimming pool involved in the case has now been completely demolished, all operating facilities in the venue have been demolished and abandoned, and the site involved has been handed over to the Shierlituu Village Committee. The company's health license, cultural market license, tobacco license (automatically canceled after one year without review) and tax registration certificate have all been canceled, and the business license will be canceled in accordance with the law after the personal criminal penalty against the company's legal representative Wang Xibin is completed.
