Recently, the Department of Human Resources and Social Security of Zhejiang Province released the third batch of typical cases of major violations of labor and social security laws in 2023 and the list of entities subject to joint disciplinary action for dishonesty in defaulting on migrant workers' wages.

Among the third batch of typical cases of major violations of labor and social security laws in 2023, the following are related to the construction sector: 

Case of Fujian Tianheng Construction Group Co., Ltd. defaulting on labor remuneration

Fujian Tianheng Construction Group Co., Ltd., Unified Social Credit Code: 91350982683059174U, Address: Rooms 1601-1603, Building 1, Dingrong International, Fuding City, Ningde City, Fujian Province, Legal Representative: Wang XX.

On June 29, 2021, the Human Resources and Social Security Bureau of Cangnan County received a complaint from a worker reporting that the entity had defaulted on labor remuneration. Investigation revealed that on December 5, 2017, Fujian Tianheng Construction Group Co., Ltd. undertook the relocation and reconstruction project of Chixi Town Primary School, and subsequently failed to pay Pan XX labor remuneration of 20,000 yuan. In June 2019, due to funding shortages and other issues, the entity subcontracted the project to Yu XX; from July 2019 to November 2020, Yu XX hired workers to carry out construction in the name of Fujian Tianheng Construction Group Co., Ltd., and subsequently failed to pay wages totaling 919,550 yuan to more than 40 workers including Chen XX. On July 9, 2023, the Human Resources and Social Security Bureau of Cangnan County lawfully issued the Order for Correction within a Time Limit under Labor Security Supervision, which the entity failed to comply with before the deadline.

On July 15, 2023, the Human Resources and Social Security Bureau of Cangnan County lawfully transferred the case to the public security authorities on suspicion of the crime of refusing to pay labor remuneration. On May 30, the People's Court of Cangnan County lawfully ruled that Fujian Tianheng Construction Group Co., Ltd. was guilty of the crime of refusing to pay labor remuneration and imposed a fine of RMB 20,000; ruled that Wang XX was guilty of the crime of refusing to pay labor remuneration, sentenced him to one year's imprisonment with a one-year and ten-month suspended sentence, and imposed a fine of 15,000 yuan; and ruled that Yu XX was guilty of the crime of refusing to pay labor remuneration, sentenced him to ten months' imprisonment with a one-year and six-month suspended sentence.‍

Case of Zhejiang Jingyue Construction Co., Ltd. defaulting on labor remuneration

Zhejiang Jingyue Construction Co., Ltd., Unified Social Credit Code: 91330701MA2K1A0L35, Address: Room 301-1, Building 2, Xizhong East Road, Jindu Market, Dongcheng Subdistrict, Yongkang City, Actual Controller: Lü XX.

On September 21, 2022, the Human Resources and Social Security Bureau of Yongkang City received a complaint from a worker reporting that the entity had defaulted on labor remuneration. Investigation revealed that the entity was the general construction contractor for the project of Yongkang Yilong Electric Tool Accessories Factory with an annual output of 800,000 sets of electric tool accessories, the project of Yongkang Jianfeng Resin Grinding Wheel Mesh Factory with an annual output of 200,000 sets of hand tool products, and Buildings 1#, 10#, 11#, and 12# of Phase I of the Jingshanxia Returned Land Construction Project in Yongkang Economic Development Zone, and that the entity had defaulted on labor remuneration totaling 1,718,122 yuan owed to 159 workers. On December 2, the Human Resources and Social Security Bureau of Yongkang City lawfully issued the Order for Correction within a Time Limit under Labor Security Supervision, which the entity failed to comply with before the deadline.

On January 18, 2023, the Human Resources and Social Security Bureau of Yongkang City lawfully transferred the case to the public security authorities on suspicion of the crime of refusing to pay labor remuneration. On September 22, the People's Court of Yongkang City ruled that Zhejiang Jingyue Construction Co., Ltd. was guilty of the crime of refusing to pay labor remuneration and imposed a fine of RMB 100,000; and ruled that Lü XX was guilty of the crime of refusing to pay labor remuneration, sentenced him to one year's imprisonment with a one-year and six-month suspended sentence, and imposed a fine of RMB 50,000.‍
