　　With the rapid development of China's economic construction, the number of construction machinery and equipment and construction machinery operators has surged. At present, about 1 million units of various types of construction machinery are active on the front lines of production and construction across the province. Because regulatory functions have not been clearly defined, construction machinery has long remained in a blind spot of safety supervision, with a large number of hidden hazards, frequent casualties in the production process, significant losses to people's lives and property, and serious impact on social harmony, stability and sound economic development. In order to standardize and strengthen the safety management of construction machinery, the relevant matters are hereby notified as follows:

　　I. Fully understand the significance of strengthening the safety supervision of construction machinery

　　Construction machinery is an important object of work safety supervision and an important guarantee for the production safety of engineering construction. Standardizing and strengthening the safety supervision of construction machinery is of great significance for safeguarding the lives and property of the people and ensuring the sustained and stable work safety situation of the whole province. Departments at all levels throughout the province must deeply grasp the spirit of General Secretary Xi Jinping's important instruction that "economic development must not come at the expense of people's lives," fully understand the severity of the current work safety situation, effectively enhance the sense of responsibility and urgency regarding the safety supervision of construction machinery, keep the string of work safety tightly drawn, and hold fast to the red line and bottom line of work safety.

　　II. Work requirements and main tasks

　　(1) Work requirements. Thoroughly implement the spirit of the 18th National Congress of the Communist Party of China and the Third, Fourth and Fifth Plenary Sessions of the 18th CPC Central Committee, firmly establish the concept of "people-oriented, safe development," adhere to the principle of "safety first, prevention foremost, comprehensive management," and fully implement the requirements that "whoever is in charge supervises" and that "those who manage an industry must manage safety, those who manage business must manage safety, and those who manage production must manage safety," so as to standardize and strengthen the work safety management of construction machinery. With government supervision as the主导 (leading force) and the industry self-discipline management of the Hunan Provincial Urban and Rural Construction Machinery Management Center as the support, we shall improve rules and regulations, perfect safety standards, raise technical levels, consolidate the foundation of work safety, and strengthen the implementation of the main responsibility for work safety of construction machinery production and operation units and individual practitioners as well as accountability.

　　(2) Main tasks. Comprehensively strengthen the safety supervision of construction machinery production operations; in conjunction with the "Work Safety Supervision and Law Enforcement Year" and the special action of "cracking down on illegal activities and rectifying violations," strengthen supervision, enforce the law strictly, and carry out concentrated rectification of unlicensed operations, illegal operations and other acts in construction machinery; improve the safety management rules and regulations of the construction machinery industry, and establish in accordance with the law the requirements for operators to work with certificates, the registration of construction machinery, and safety protection measures for technical equipment; promote the implementation of national and industry standards, and eliminate construction machinery and equipment that are listed in the catalog of equipment seriously endangering production safety formulated and published by the state and the provincial people's government. By establishing a long-term mechanism for work safety, effectively curb production accidents in the construction machinery industry and minimize casualties and property losses caused by accidents.

　　III. Scope and objects of construction machinery safety supervision

　　The scope and objects of supervision are all enterprises and practitioners in the province involved in construction machinery. This mainly includes the following ten major categories of construction machinery and equipment:

　　1. Excavation machinery (excavators, backhoe loaders, tunneling machinery, etc.);

　　2. Earthmoving and transport machinery (bulldozers, loaders, scrapers, graders, etc.);

　　3. Compaction machinery (road rollers, tamping machinery, vibrating machinery, etc.);

　　4. Road machinery (pavers, milling machines, etc.);

　　5. Piling machinery (pile drivers, pile pressing machines, drilling machines, rotary drilling rigs, etc.);

　　6. Concrete machinery (mixer trucks, vibrators, concrete pump trucks, etc.);

　　7. Decoration machinery (coating spraying machinery, floor finishing machinery, window cleaning machines, etc.);

　　8. Mining machinery (rock drills, crushers, mining battery vehicles, belt conveyor equipment, etc.);

　　9. Lifting machinery (tower cranes, wheel cranes, crawler cranes, winches, construction hoists, etc.);

　　10. Comprehensive machinery (stackers, tractors, clamping machines, etc.).

　　IV. Promote and strengthen the work safety management of construction machinery

　　Establish and improve a safety management model that combines government supervision with industry self-discipline management, give full play to the role of the Provincial Urban and Rural Construction Machinery Management Center, and advance the standardization and normalization of construction machinery industry management throughout the province.

　　(1) Carry out a general survey, registration and numbering of construction machinery safety, establish a safety information database for construction machinery, and advance the informatization of construction machinery work safety supervision.

　　(2) Carry out work safety training, conduct safety knowledge training for construction machinery operators and managers throughout the province, and continuously improve the safety knowledge and practical operating skills of construction machinery practitioners.

　　(3) Establish an emergency rescue database for construction machinery, actively use advanced systems, and integrate emergency rescue equipment through information platforms to ensure that emergency rescue equipment can be "found and dispatched," build a construction machinery emergency rescue system, and give full play to the role of construction machinery in emergency rescue.

　　(4) Explore the establishment of a system of regular inspection of the safety performance of construction machinery and equipment and scrapping within a time limit, eliminate equipment endangering production safety in accordance with the law, and improve the intrinsic safety level of construction machinery.

　　(5) Promote the establishment of a commercial insurance system for construction machinery work safety, and provide work safety service guarantees for construction machinery.

　　(6) Organize the drafting of the "Regulations on the Management of Construction Machinery of Hunan Province" and the "Measures for the Safety Supervision and Management of Construction Machinery of Hunan Province."

　　V. Standardize and strengthen the institutional development of construction machinery safety supervision

　　(1) Strengthen the general survey and registration, and establish and improve the construction machinery information management system. All cities, counties and urban districts shall, relying on the Provincial Urban and Rural Construction Machinery Management Center, establish data platforms to achieve all-round, full coverage, with no omissions and no blind spots, so that the situation is clear and the records are clear. This shall ensure that, during emergency rescue, centralized deployment and centralized command can be carried out, giving play to the maximum effectiveness of construction machinery in emergency response.

　　(2) Strengthen safety training and improve the safety awareness and safety technical level of practitioners. The principal persons in charge of enterprises involved in construction machinery production and operation activities and individual construction machinery practitioners must participate in training on work safety laws and regulations and technical knowledge in accordance with the law, and must possess work safety knowledge and management capabilities corresponding to the production and operation activities in which they are engaged. Safety supervision departments at all levels must enforce the law strictly and, in accordance with laws and regulations, seriously investigate and deal with practitioners who take up posts without safety training.

　　(3) Strengthen safety inspections and promptly eliminate hidden hazards in construction machinery safety technology. All types of production and operation units in the construction machinery industry must establish and improve systems for the investigation and governance of hidden hazards of production safety accidents. The principal persons in charge of units must regularly organize and carry out hidden hazard investigations and technical fault inspections, establish an evaluation system for the effectiveness of hidden hazard and technical fault investigations led by professional personnel, promptly eliminate and repair discovered hidden hazards and technical faults, urge the implementation of rectification measures, and put an end to operating equipment with problems. Where accidents are caused by inadequate rectification of hidden hazards, disregard of mechanical faults, or blind engagement in engineering operations to rush schedules, accountability shall be strictly pursued in accordance with laws and regulations.

　　VI. Standardize and strengthen the implementation of construction machinery safety supervision responsibilities

　　(1) Strictly implement the main responsibility for work safety of enterprises and practitioners. The principal persons in charge of construction machinery enterprises and individual practitioners, as the first responsible persons for work safety, must strengthen their sense of responsibility and legal awareness, pay close attention to the management of the construction machinery production and operation process, and strengthen on-site safety assessment and human condition evaluation of construction machinery operations. When the working site environment does not meet work safety conditions or is affected by human or natural disasters, operations must be stopped immediately. Enterprises or individuals that disregard work safety conditions, act recklessly to rush progress and schedules, give illegal commands, or conduct illegal operations that cause work safety accidents shall be severely punished in accordance with relevant regulations, and criminal liability shall be pursued in accordance with the law.

　　(2) Strengthen territorial management and departmental supervision responsibilities for construction machinery work safety. Departments with work safety supervision responsibilities at all levels must firmly establish the idea of "territorial management and responsibility for one's own territory" and, in accordance with the requirements of "whoever is in charge supervises" and "whoever approves licenses supervises," and in a spirit of being highly responsible for the lives and property of the people, dare to take responsibility and be courageous in taking charge. They must, in light of the actual work safety conditions of construction machinery in their respective regions and departments, formulate effective measures, strengthen territorial management and departmental supervision responsibilities, quickly put safety supervision in the field of construction machinery production onto an institutionalized and standardized track, and ensure production safety.

　　(3) Increase law enforcement efforts and deepen the investigation of hidden hazards. Governments at all levels must provide unified leadership, fully implement the work safety supervision responsibilities of departments such as work safety, housing and urban-rural development, industry and information technology, quality supervision, public security, transport, land and resources, industry and commerce, and water resources, strengthen coordination, and form joint forces. Encourage exploration of methods such as authorized law enforcement, delegated law enforcement and government purchase of services, carry out joint inspections, investigate and govern hidden hazards, and severely crack down on illegal production and construction activities. For construction machinery with major hidden hazards or operating with problems, effective measures must be taken for key supervision and follow-up rectification. Supervision and inspection of production sites must be strengthened, and the "three violations" of illegal command, illegal operations and violation of labor discipline must be strictly investigated and dealt with.

　　Departments at all levels must do a good job in organizing and implementing the strengthening of construction machinery work safety, formulate specific measures for implementing the requirements of this Notice in their respective regions and industries, strengthen supervision, inspection and guidance, and promptly study, coordinate and resolve prominent problems arising in the course of implementation. The Provincial Work Safety Committee will conduct supervision and inspection at an appropriate time, keep abreast of work progress, and ensure that all measures are implemented in place.
