Is It Difficult to Control Construction Noise?

The phenomenon of nighttime construction noise disturbing residents at building sites affects the quality of life of the general public and has become a major environmental issue for nighttime complaints. The author believes that a series of measures are urgently needed, combining technical and human prevention, to establish a comprehensive prevention and control system.
Difficulties in Supervising Nighttime Construction Noise
First, penalties are light and the cost of violation is low. Taking Dalian as an example, although the "Dalian Environmental Protection Regulations" have clear provisions on penalties for illegal nighttime construction projects, stipulating a fine of "not less than 5,000 yuan and not more than 50,000 yuan" for violations, this is not much for the construction party. If the project is delayed, their losses may far exceed this amount. Therefore, some construction sites, in order to rush the schedule and enjoy the convenience of "more hauling and faster running" without traffic jams at night, would rather be fined than stop nighttime construction. The relevant regulations have not played their due deterrent role.
Second, supervision methods are single and law enforcement forces are insufficient. Taking Dalian as an example, currently the emergency handling of nighttime construction complaint cases is only through the way of supervision personnel rushing to the site for inspection, evidence collection and resolution. The management of construction noise is only undertaken by the environmental protection department, and law enforcement forces are seriously insufficient.
Third, evidence collection is difficult. Complaint investigation and handling are lagging, and nighttime construction disturbances are dynamic. In many cases, by the time supervision personnel arrive at the scene, the work has stopped and evidence cannot be obtained. It is common for construction parties not to cooperate with investigations, either with gates closed, claiming the person in charge is not present, or even with a rude attitude, threatening the personal safety of supervision personnel.
Countermeasures for Supervising Nighttime Construction Noise
In order to solve the problem of nighttime construction noise disturbing residents faster and better, the author believes that in addition to continuing to strengthen supervision and increase patrol frequency under existing conditions, we should also start from the organic combination of "technical prevention" and "human prevention" to build a comprehensive prevention and control system.
In terms of "technical prevention". A digital construction site supervision system should be established. With the rapid development of science and technology, the combination of noise signals and video signals, transmitted through Internet broadband or mobile 3G networks, can achieve remote monitoring functions.
The operation of the monitoring system will strengthen the supervision of the environmental protection department, timely and effectively grasp the dynamic situation of on-site construction, become a powerful supplement to traditional law enforcement methods, make up for the shortage of supervision and law enforcement forces, and provide very favorable support for investigation and evidence collection.
Although a certain amount of capital investment is required in the early stage, as long as it is diligently maintained, properly managed, its service life is extended, and utilization efficiency is improved, the cost of manpower and material resources in conventional law enforcement can be reduced. In essence, it saves overall administrative costs while improving administrative efficiency.
In addition, under the conditions of satisfying construction technology, construction units should be encouraged to prioritize new processes and equipment with lower noise levels, and actively use diesel pile drivers, static pile drivers and other equipment to reduce noise decibels.
In terms of "human prevention". First, implement total quantity control of nighttime construction noise and strictly manage nighttime construction. The environmental protection department, based on the scale, structure, drawings, equipment, environment, etc. of the construction site, listens to reasonable suggestions from the construction unit, solicits residents' opinions, verifies the total nighttime construction time for each construction stage, and requires the construction unit to make a commitment. Environmental protection staff, in accordance with the regulation that "the cumulative approved nighttime construction operation time for each construction stage shall not exceed the total time verified for that stage," issue a "Nighttime Construction Approval Certificate" and "Notice" to construction units that meet the requirements, and urge them to post them at the construction site and nearby residential areas at least one day in advance. The total amount of nighttime construction operations verified for each construction stage shall not be increased, nor shall it be adjusted from the next stage.
Second, increase the management of nighttime construction. For noise sources of building construction, the state should further improve the product noise standards for construction machinery, eliminate high-noise machinery, and promote the use of low-noise machinery. By increasing the collection of excessive noise pollution discharge fees for nighttime operations, enhance the consciousness of construction units to strengthen noise pollution control and reduce the frequency of nighttime operations. Crack down on illegal acts of unauthorized construction in violation of relevant regulations. For approved nighttime construction operations, the environmental protection department should strengthen supervision and law enforcement inspections during nighttime construction. For those who violate the approval opinions during construction, promptly require rectification to effectively reduce the impact of nighttime construction on surrounding residents.
Third, properly carry out explanation and guarantee work for the masses. Relevant management departments should make it clear that doing a good job in explaining and guaranteeing for the masses is a duty that construction units must perform. One day before construction, nearby residents should be notified, and patient explanations should be made so that nearby residents, especially those with special needs, understand the situation and are prepared in advance. This not only allows the masses to promptly raise problems in construction and exercise their right to supervise, but also enables them to take measures such as relocation in advance to reduce the impact of noise pollution.
